Colts Linebacker Josh McNary Facing Rape Charges

Josh McNary of the Indianapolis Colts has reportedly been charged with rape according to CNN. Peg McLeish, a spokeswoman for the Marion County Prosecutor’s Office, made the announcement on Wednesday (Jan. 14).

Leigh said that 26-year-old McNary hasn’t been arrested as of yet, but there is a signed arrest warrant. In addition to rape charges, McNary was also charged with felony criminal confinement and misdemeanor battery.

A 29-year-old woman called nearby law enforcement on Dec. 1 according to an affidavit of probable cause. She reported that she was raped earlier from a man she met during a night out at a bar.

In the affidavit, the woman claimed that she refused to have sex with the man while fighting him off; scratches were left on his neck, back, shoulder and face. Apparently, the man coerced her into have sex on his bed. When she left the apartment, she took the man’s cell phone.

After an examination from a forensic nurse, it was proven that the woman suffered vaginal injuries and dried blood behind one ear.

Reportedly, detectives used the cell phone to track down McNary the following day. Though he cooperated with police and was served his rights, McNary opted for a lawyer.

Coincidentally, McNary did have scratches on his back, neck and shoulder. He also had a scratch on his stomach. During a search of McNary’s apartment, the woman’s clothing and an earring were retrieved.

According to MadameNoire, the Colts have released a statment on McNary’s behalf:

“At this time we are very concerned and trying to find out what the relevant facts are, but we have insufficient information to venture any opinion. As we learn more we will make appropriate updates.”

McNary’s attorney, Edward F. Scharger said:

“Joshua McNary unhesitatingly denies all accusations made against him. Following the public release of these allegations, Joshua immediately reported to law enforcement officials in a respectful and peaceful manner.”

Another NFL star who was accused of rape was Darren Sharper. The former New Orleans Saints player was indicted last year on rape and drug charges. He was accused of raping seven women and drugging 11.
